This is a legal agreement between MyVGM, sellers ("Sellers") who offer titles for sale on the MyVGM service, and buyers ("Buyers") who purchase titles through the MyVGM service.
MyVGM provides the platform and services for Sellers to upload and offer original musical compositions, arrangements of public domain works, and co-arrangements of copyrighted works ("Titles") for sale to Buyers.
Sellers grant non-exclusive licenses to MyVGM to store, distribute, access, play, print, transpose, and create editable copies of the Titles, including associated content like cover art, tabs, and recordings, based on the type of Title and purchase terms.
Sellers grant non-exclusive licenses to Buyers to store, access, play, print and transpose the Titles, based on the type of Title and purchase terms.
Sellers set a list price in USD for each Title. MyVGM can convert and display prices in other currencies. Buyers pay the final sale price in applicable currency based on any promotions or taxes.
Sellers earn commissions on sales based on schedules set by MyVGM. Current commission rates are 75% of profits per sale. Commissions accumulate until meeting minimum payment thresholds of $50.
Buyers purchase licenses to use Titles based on the price paid, format purchased, and number of performers allowed. Licenses grant usage rights but Sellers retain ownership.
Usage rules restrict how Buyers and Sellers can access, distribute, and interact with the service and content. Users must comply with copyright laws.
MyVGM can make changes to the terms at any time with notice of material changes. Users are responsible for regularly reviewing the agreement as use of the service after changes constitutes acceptance.
The agreement disclaims warranties and liability for the service, content, and user interactions. Users waive rights to injunctive relief and agree to limit claims to monetary damages.
For copyright disputes, proper DMCA takedown notice procedures must be followed. Users must comply with dispute resolution processes of informal negotiation and binding arbitration.
User submissions, including feedback and content, can be used by MyVGM. Users grant expansive licenses for use of submissions.
Privacy policies govern how MyVGM collects, uses, and discloses user information. Users agree to the terms of the incorporated privacy policy.
Violating the terms can lead to account suspension or termination.
Users cannot sublicense rights granted by the agreement.
MyVGM prefers to accept a submission from one billing account only, and it is the responsibility of that account to split commissions between all parties involved in creating the work for sale, unless arrangements are made for income splits.
